Terms of Business
The deal in plain English: what we do, what it costs and what is covered.

These terms apply when you use M. J Statham & D Wilkinson (ABN 58 831 357 113), trading as MXD Solutions, to fill a permanent role. In these terms, "we" means MXD Solutions, "you" means the business hiring, and "candidate" means anyone we introduce to you.
1. What we do
We find, screen and introduce candidates for permanent trades and construction roles in Queensland, New South Wales and Victoria. We do permanent placement only. Anyone you hire works for you, on your books, and we are not their employer.
2. No hire, no fee
There is nothing to pay upfront and there are no ad costs. You only pay if you hire a candidate we introduced.
3. Fees
Our fee is a flat amount set by the level of the role, not a percentage of salary. All fees exclude GST, which we add to your invoice.

Repeat hires. You get 10% off every hire after your second in a 12-month period.
4. Payment
The fee is due when your hire starts, and is payable within 14 days. Smaller businesses can ask to split it, with half paid on start and half at day 30.
5. Candidates
Once we have confirmed your brief, we aim to send you your first screened, licence-checked candidates within 5 business days, building to a shortlist of 3 to 5. If we have not sent you a shortlist within 1 month of confirming your brief, you can end the brief with no obligation.
6. 3-month free replacement
If your hire quits or is let go for performance within 3 months of their start date, we will find a replacement at no extra fee. This applies as long as:
- you paid the fee on time; and
- the role has not been made redundant.
The replacement guarantee applies once per placement. You give us 6 weeks to search exclusively for the replacement. If we can't find one in that time, we will give you a credit for the fee you paid. The credit can be used against another hire with us and is valid for 12 months.
7. Candidates we introduce
If you hire anyone we introduced within 12 months of that introduction, in any role, the fee for that role applies. This includes hiring them through another business or agency.
8. Screening
Before you meet a candidate, we check their licence on the relevant state register where the trade requires one, complete a phone screen and take two supervisor references. We complete a right-to-work check before any offer goes out.
These checks reflect what we could confirm at the time. The decision to hire is yours, and you remain responsible for your own employment obligations, including pay, super, inductions and workplace safety.
9. Fees to candidates
We never charge a candidate a fee. Only the employer pays.
10. Privacy
You agree to use candidate details only to assess them for your role, and to handle them in line with our Privacy Policy.
11. Liability
- Our total liability for a placement is capped at the fee you paid for that placement.
- We are not liable for indirect or consequential loss, including lost profit.
- You direct your hire's work and are responsible for checking they are suitable for it.
- Nothing in these terms limits any liability that can't be limited under the Australian Consumer Law.
12. Accepting these terms
These terms apply once you sign them or ask us to start on a role, and before we send you any candidate. If we change them, the new version applies to roles you brief us on after that date. These terms are governed by the laws of Queensland.
